My sister who has total custody of my nephew is willing to sign over custody to my husband and I as is his biological father too, although he does not have custody per the divorce decree in Florida. The problem is, my husband and I live in Ohio, My nephew and sister live in Minnesota but the divorce and custody agreement were done in Florida. Ohio is telling me that I may have to file for custody in Florida, But they have moved from Florida a good 3-5 years ago. Does Florida still have jurisdiction over this?!? I get free legal services through my husbands employer, they are not returning my phone calls. Another lawyer is helping out but I am just curious as to what info I can get regarding custody involving 3 separate states. I might mention also that my nephew is 15 going to be 16 in a few months and that ALL parties involved are in full cooperation and agreeable to the custody switch. I need help A.S.A.P! Any information on what to do would be greatly appreciated.
