Can I give notice to vacate to my brother? We live in Mississippi in my mothers home which is going through probate and he refuses to pay any bills mortgage ect.

It depends upon your and his status as heirs to the estate, the terms of your mother's Will and the probate process. Your best source of information will be the people supervising probate.

Sorry. Only a landlord or owner of the property can give that kind of notice. Your only option (if the house will be yours after the probate) would be to evict him "after" probate. keep records of the bills and take him to court when the house is "yours". You could do the bills thing now but, probate will complicate the proceedings and the judge will most likely tell you to wait until it is completed. His responsibility to pay his part of the bills doesn't depend on who owns the house. Eviction does.
