A company is merging with another company. The senior management structures of company A is not being changed. Managers in company B are being slotted into the structure at company A. Where there is no obvious slotting in post, competition will apply and those unsuccessful will be redundant. Should the managers at company A also be at risk and required to be considered or apply for posts? What if the senior managers at company B were experienced and qualified enough to do the senior manager post at company A which are not being changed? Could this be unfair dismissal for someone in company B?

Question found in Employment Law
Hi There,

This is undoubtedly the most difficult situation in which to apply employment law. If a company advertises for, say, a chief accountant and two people apply, one who is the chairman's nephew with poor qualifications and one who is very highly qualified, then if the nephew gets the job, the well-qualified person has a good case.

But in a merger, the company's board has to not only appoint the best qualified and most able people but also to consider the group dynamics of the new management. It might not be in the best interests of the company to appoint some people no matter how well qualified they are, so it becomes extremely difficult for individuals to bring a case of unfair dismissal or constructive dismissal.

In the end, managements must have the freedom to appoint the people who they honestly believe will be best for the company and will do the best for its shareholders.

Why does cheese taste better grated?

Discuss this question

Question found in Food And Drink In General
Hi There,

Cheese is chemically a very complex substance and like many foods - wine for instance - it only realises its full range of flavours and aromas once it has breathed a little - that is, become exposed to air and started to oxidise.

When you grate the cheese you expose the maximum surface area to the air and give the oxidation process a head start.

What are my legal right with my child?

Discuss this question

Question found in Human Rights
Hi There,

I'm assuming from your question that you may have split up with your partner and wish to know about rights of access and so forth.

The situation is that you and your partner should agree what access you both have to your child, who the child should reside with normally, etc etc. If you are unable to reach agreement with your partner over these questions then it would be usual for you both to go to the family court where an experienced judge will consider all the facts, take the best interests of the child into consideration, and make a court order regarding access rights etc.

I have not gotten paid for my job that I just started, but everyone else did. What do I do?

Discuss this question

Question found in Legal Other
Hi There,

Contact the accounts/payroll person and ask them to explain what's happening. It may be that you have to work a week/month in hand which means that you won't receive any pay at the end of the first week/month, but at the end of the second and they will owe you a payment when you leave.

If this is the case and it causes you financial hardship with rent or whatever, explain the situation and ask for an advance against your first pay check. They will probably be reasonable if you explain it nicely.

I live in Sacramento California and I need to know where I can take a bible that was made in the late 1700s or 1800s to be sold, or where I can take it to be appraised?

Discuss this question

Question found in Miscellaneous
Hi There,

The easiest way to get an idea of the value of your Bible is to look on eBay. At any one time there are more than 1,000 Bibles or related items being offered (currently it's more than 1,700). Look for Bibles similar to your own and see how they are being described and what prices they are fetching. Don't misled by people merely asking for silly prices that are not being paid. Also remember that condition is everything.

Secondly, I don't know the West Coast well but I imagine that you must have offices of the major auction houses like Sotheby's and Christie's either in Sacramento or in LA. They have experts who will look at your Bible and value it at auction, without charge.

How to write a book report?

Discuss this question

Question found in Education In General
Hi There,

The first step is to read through the book making notes as you go of anything that catches your eye. Don't feel you've got to read and understand every word - it's OK to skip bits that are boring (it's the author's fault not yours).

Give the facts about the book at the beginning of your report: title, author's name, publisher's name, date of publication, ISBN number, price, and whether hardback or paperback edition.

Provide a brief overview of the book's content. This doesn't have to be lengthy if you don't want it to be - it could be just "Joe Soap's History of World War Two takes the reader from the battlefields of France to the Heart of Germany in 1945." Or "Mary MacGuire's 'Battle of Hearts' is a love story set in the 1940s".

Things you might want to comment on (or not) in a non-fiction include: how easy the book is to read and understand, how detailed and factual it is, how well referenced, whether the author's conclusions are supported and justified by his/her data.

Things you might want to comment on in fiction include: how convincing the characters are, how realistic the dialogue is, whether the story itself moved and convinced you.

And finally of course whether or not you enjoyed the book.

Can I restrict a 125cc bike to a 50cc so that it is legal for a 16 year old to ride with a CBT and provisional licence in the UK?

Discuss this question

Question found in Motorcycles
Hi There,

I'm not sure if your question is intended to be a legal one or a technical one.

If you can replace the 125cc cylinder of your bike so that its capacity is 50cc then yes it will be legal for a 16 year old to ride it because that is what the law says. But you would have to make absolutely certain that the capacity did not in any way exceed that figure or it would be illegal.

If you are asking how can you physically restrict the capacity of a 125cc cylinder, the answer is that I don't believe you can do this in a way that would satisfy the law because it will always be a modified 125cc cylinder. You would have to replace it completely with a 50cc cylinder.

Hi. I would like to know if the book "One Hundred Strokes of the Hairbrush Before Going to Sleep," " from Melissa Panarello is by a real true story? Thanks

Discuss this question

Question found in Books & Authors
Hi There,

As you probably know, there has been a lot of controversy over this. At one stage it was said that the girl herself didn't even exist as she had refused to be photographed - although we know know she is real.

Is her novel based on her own experiences as she claims? That can only be a matter of opinion. As a professional writer, I doubt it very much. I believe that all her episodes have the character of fantasies, but she has very cleverly disguised this by turning them into the fantasies of the men she encounters.

How likely is it, for example, that a 15 year old girl would go to bed blindfolded with five men at once?

Miss Panarello claims that this happened to her and that it didn't bother her at all. If that is really true, then I would say that she is not only a remarkable novelist but also a psychopath.

Is the recognition and affiliation of colleges mandatory or not in India?

Discuss this question

Question found in Universities & Colleges
Hi There,

I believe that the situation in India is the same as in the UK and US. Anyone can start up a school, college or university. Anyone can hold exams and anyone can award degrees and other qualifications - there's no law against it.

However, in each country the Department of Education maintains a register of schools, colleges and universities that it recognises as having been subject to inspection and having reached the required standards laid down by the DoE.

Also, examination awards that would be accepted by a majority of employers are undertaken only by recognised institutions. So that an 'A' Level in Maths awarded by Oxford or Cambridge would be recognised but an 'A' Level in Maths awarded by the Richard Milton School of Cookery, Astrology and Shoe Repairing would not be recognised.

Check out the institution with your Department of Education.
