I was at a night club on Sunday and as I walked down some stairs a strobe light came on flashing fast and as the strobe began to slow down I started to have a fit. I was told I was out of it for about 5 seconds but when I woke up I was still stood up on the stairs. Can some one help me plz?

Question found in Personal Health Issues
The situation and your reaction are consistent with a petit mal seizure.

People subject to seizures can be triggered by many things, flashing lights, video games, etc.

Petit Mal (minor) and Grand Mal (major) seizures indicate a serious problem and need to be properly evaluated. I would STRONGLY suggest that you immediately seek the advice of a qualified neurologist.

Ignore this and you risk a seizure while driving because an ambulance passes with flashing lights. You will be held responsible, financially and legally, for the result.

Is it legal to charge someones credit card a % if they forget to close their tab out at the end of the night. Is it different from state to state? I live in Wisconsin?

Discuss this question

Question found in Consumer Law
That you did not tell them you were leaving is merely an inconvenience. You had made arrangements in advance to pay your bill in full. The reason they want your credit card to run a tab is because you could leave without notice. This does not incur a penalty, they were already paid.

Wisconsin law notwithstanding, this falls under federal credit card and banking laws (Regulation E).

A merchant cannot add charges to a credit card simply because they feel like it. All charges must be justified, shown on the bill and agreed to by the card holder. Running a tab means that you agree to pay for the drinks, etc. It does not mean that you agree to pay whatever charges the merchant decides to add to your bill.

Contact your bank's "Regulation E" Dept. and dispute the additional charges (and ONLY the additional charges). Chances are excellent they will be refunded.

If this merchant is involved in several complaints of this nature, they could lose their authority to accept credit cards.

Is it possible to obtain money from my fathers will while he is still living?

Discuss this question

Question found in Legal Other
No. A Will can be changed at any time and the beneficiaries may or may not even be aware of its terms. It does not become effective until death.

If alive, nothing prevents your father from giving you a gift. It's his money.

My credit union made a mistake on my loan account and cleared off my loan! they put a mans cheque into my account instead of his! since then

I have thought that my loan was paid and have spent my savings, now the credit union wants me to take out another loan in order for me to start making payments again?

Discuss this question

Question found in Banking & Finance
This was an error, not a gift. You still owe the money.

I would not accept a new loan on terms any worse than you had (remaining balance, interest rate, payment schedule, etc.). Perhaps you can negotiate better terms in view of the error.

You still owe the money, but you should not suffer any penalties due to their error. Neither does their error constitute a gift that relieves you of your responsibility.

My father died last year. I am executor and next of kin. The house was left, half to the woman he lived with and half to be split four ways between myself and my siblings. His possessions were left to his children. The woman he lived with is totally unreasonable and will not let us in the house to collect personal possessions (photos and other things of sentimental value). What can we do?

Discuss this question

Question found in Legal In General
As executor, this implies a Will. If so, you have your father's legal authority to dispose of his estate in accordance with his wishes. The Will may require probate (court supervision), but that will provide you with a court order allowing you to enter the property, by force if necessary, to dispose of his estate in accordance with his wishes.

If she interferes, she could be arrested for obstruction of justice. If she disposes of or hides any property, it is misappropriation, possibly rising to the level of theft. I would strongly suggest that you not tip your hand before arrival with the Sheriff and proper court documentation or she could wreck the place in retribution. If you suspect this is possible, you can have her evicted to protect the property pending resolution. It's not hers, she only has a partial claim to it's value. There are no "squatter's rights" in estate resolution.

As executor, the ONLY way to dispose of the house properly is for everyone's interests to be purchased by the estate from the proceeds of selling the house. If she wants to keep it, she will need to finance it and pay off the siblings. If she cannot or will not, she can be evicted and you will give her a check for her share of the real estate.

You can be as tough or as nice as you need to be. Your job is to resolve your father's estate as he directed to the best of your ability.

If a bar fight ends up in front of my house, and I get injured with a bottle from that bar, who is liable?

Discuss this question

Question found in Human Rights
The participants will be liable unless you can conclusively demonstrate that the bar in question promoted the altercation or served them after intoxication (dram shop laws).

You neglected to mention whether you were also a participant. If so, your injuries could be the result of "mutual combat" and you alone are liable for them.

Comments :
Hello, thank You for responding to my question. I was not a participant in the fight, but the bouncers from the bar were saying to take the fight down the street. A woman protecting her car was hit by one of the participants,I tried to stop him and was hit with a bottle while the bouncers did nothing.

I broke my ankle in 3 places, had an operation put screws and plate in was in a lite cast for 4 wks and was walking on it, I had my cast off and got home and my scar was warm and red, I went to my doctors and he said infection and gave me antibiotics. How could this be when I was keeping it away from things and resting it?

Discuss this question

Question found in Health & Fitness In General
Difficult to determine definitively from a distance, but most likely would be a source of infection that entered the wound during surgery. Equally possible would be something seeped into the wound while it was healing. Perspiration inside the cast could wash bacteria into the wound.

Take ALL of your antibiotics. Don't stop just because you feel better or the infection will return. With friends.
